Welcome to Medilinks. By accessing our website and using our services, you agree to comply with the following terms and conditions. Please read these terms carefully before using our services.

1. Introduction

Medilinks Access Pty Ltd ACN 658 402 352 (“we”, “us” and “our” and “Medilinks”) provides the Services to Referred Clients.

For the purposes of these terms and conditions, the following definitions apply:

“Medilinks” means Medilinks Access Pty Ltd ACN 658 402 352.
“Medilinks Website” means www.medilinks.com.au.
“Personal Information” means contact information, health information and any other information reasonably relevant to the provision of the Services or provided by a Referred Client.
“Practitioner” means the psychologists and psychiatrists contracted to Medilinks for the purpose of providing the Services.
“Referred Clients” means veterans who wish to engage Medilinks for its Services.
“Services” means the assessment of a Referred Client’s mental health conditions linked to their service with the Australian Defence Force (“ADF”) and the production of a thorough and objective report to the Department of Veteran Affairs (“DVA”).
“Terms & Conditions” means these terms and conditions and any other instructions, notifications of documents sent by Medilinks from time to time. A reference in the Terms & Conditions to the singular includes the plural and vice versa.
“User” means representatives of Referred Clients.

Medilinks reserves the right to change these Terms & Conditions at any time without notice, subject to applicable federal or
state/territory legislation, by posting such changes on our website www.medilinks.com.au.

The laws of the various State/Territories in which the relevant Referred Client resides apply to the Terms & Conditions.

By using Our services and website Users agree to abide by these Terms & Conditions and any amendments to the Terms & Conditions as posted to our website.

If any of these Terms & Conditions is found to be invalid or unenforceable, that invalidity or unenforceability will not affect the remainder of the Terms & Conditions, which will continue in full force and effect.

2. Services

The User acknowledges that the Services are not treatment plans for mental health conditions for Referred Clients.

The User acknowledges that the Services may include an analysis of some matters which only incidentally relate to the Referred Client’s condition(s), such as past conditions and life history generally.

The User acknowledges that the Practitioner(s) may provide an opinion in the associated report which may not be favourable to a Referred Client’s claim(s), but is an expert opinion based on the result of the examination(s). Neither the Practitioner or Medilinks take any responsibility for the outcome of the report having a negative effect on payments a Referred Client has received or may receive from DVA whether the report is an initial claim for a condition or a claim for clinical worsening of a condition.

The User acknowledges that reports produced by at least in part on the basis of answers given to Practitioners in the relevant examinations and that if inaccurate or partial answers are given the report by the Practitioner may be inaccurate.

The User acknowledges that Medilinks will own the copyright in the report prepared by the Practitioner and will not provide the User or Referred Clients with a copy of the report.

The User acknowledges that the Practitioner is not a legal practitioner and the preparation of the report is provided independently from Referred Client’s claims to DVA. The Practitioner will not be able to provide any advice or opinion on a Referred Client’s claim and therefore will not respond to any request for their opinion about the potential success or failure of a claim to DVA.

The User acknowledges that all Referred Clients must sign an Informed Consent prior to engaging Medilinks for the Services.

3. Management of Health and Medical Information

The User acknowledges that Medilinks and the Practitioner will retain the personal and health information of Referred Clients, either in hard copy or electronically for several years, for use by the Practitioner in the event that there is a requirement to give evidence in court or to provide a supplementary report relating to the condition(s) of Referred Clients.

The User acknowledges that if at any stage a Referred Client become uncomfortable or feel unable to continue with the examination they can inform the Practitioner immediately and the examination will be ended.

4. Acceptable Use

The User agrees to only use the Medilinks Website for its intended purpose and not in any way that causes, or may cause, damage to the Medilinks Website or impair the availability or accessibility of the Medilinks Website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

The User agrees not to use this website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus or other malicious computer software.

The User agrees that it will not conduct any data collection activities on or in relation to the Medilinks Website.

The User agrees that it will not use the Medilinks Website to transmit or send unsolicited commercial communications or for any purposes related to marketing with prior written consent from Medilinks.

5. Acknowledgements

The User acknowledges that the Medilinks Website contains only general information and we make no warranty or representation that any of the information contained herein will be suitable for the User’s specific needs.

The User acknowledges that the Medilinks Website is provided “as is” without any representations or warranties, express or implied.

The User acknowledges that Medilinks does not warrant that the Medilinks Website will be constantly available, or available at all; or that the information on this website is complete, true, accurate or non-misleading.

The User acknowledges that nothing on the Medilinks Website constitutes, or is meant to constitute, advice of any kind.

6. Hyperlinks, Advertising, Sponsors & Third Party Content

Our website or application may contain the content of third parties (Third Party Content). This content may include but is not limited to hyperlinks to external (third party) websites or program sponsors. None of these things is to be taken as an endorsement, recommendation or approval of the third party, or sponsor or their products or services. We accept no responsibility for the accuracy, currency or suitability or otherwise regarding Third Party Content. Any use or reliance on such content is at your own risk and we do not accept liability for any loss, damage, costs or expenses arising as a result of the use or reliance.

Where hyperlinks to third party websites are provided, we make no claims regarding the suitability or otherwise of the third party’s products or services to your needs, nor does it warrant the third party website is free of viruses, trojans or other malicious software.

7. Communication & 3rd Party Partners

The User agrees that we may contact them to inform them of other services that we or our 3rd party partners provide.

The User acknowledges that they are not obligated to engage us or our 3rd party partners and that the offers made are for the purposes of convenience.

The User agrees and acknowledges that service-related communications will be sent to nominated contact details, subject to our Privacy Policy, regardless of contact preference.

The User acknowledges that our Privacy Policy is available on the Medilinks Website for information on how we deal with Personal Information.

8. General

The User acknowledges that any breach of these Terms & Conditions may result in Medilinks taking such action as it deems appropriate to deal with the breach.

The User agrees and acknowledges that we may revise these Terms & Conditions from time to time and that such revised Terms & Conditions will apply to the use of the Medilinks Website from the date of publication of the revised Terms & Conditions on the Medilinks Website.

The User acknowledges that Medilinks may assign its rights and/or obligations under these Terms & Conditions without notifying the User or obtaining its consent.

The User may not transfer, sub-contract or otherwise deal with its rights and/or obligations under these Terms & Conditions.
